Bob Dorn’s story of Foreclosure

Februrary 2012

I lost my condo to foreclosure in December 2009.I am still trying to put together a lot of the details, and figuring out where and why everything went wrong.

One thing is clear, I still don’t understand the mortgage paperwork, let alone, the foreclosure papers. I am just realizing that, I was supposed to respond to the Court (Middletown, NY, Orange county) at a certain date, and because I wasn’t even clear on this, it may have led prematurely to my foreclosure. At the time, several events and things came together to form a PERFECT STORM. In retrospect, It would have been helpful to know what I know now, and to have had someone to help me through this period.
I bought a reasonable sized 1 br condo in Middletown NY in October 2006, after separating from my ex-partner, the year before.

We still owned and were trying to sell a small house (about 700 sq. ft.), in Pine Bush NY. I was still working full time as a Librarian at Albert Wisner Public Library, in Warwick NY at the time. I rented an apt. in Warwick, finding it difficult to stay in the same house with my ex. Leading up to this, I was suffering from depression, over the situation with my ex- partner, in counseling, and just diagnosed with PTSD from my 9/11 experience (another story), when I still worked in NYC as an academic librarian.
It’s clear now that I didn’t understand the mortgage situation offered me, I didn’t think logically through the process, the costs involved, what might happen should the mortgage change, mortgage holding banks switching on me, without notice. I know now that I shouldn’t have been offered the mortgage, (financing 100 %, getting into two mortgages, a ‘bridge loan’ included), instead of waiting on the sale of the Pine bush house, and see what I was actually getting out of it.
I was unaware that in two years I would be forced to stop work, and be diagnosed with a debilitating disease called Meniere’s Disease.

I also was obviously the target of some loan ‘predator’ action. I had had a Bankruptcy in 2005, and was actually surprised, to have a mortgage offered to me, while I had bad credit, and was still part ‘owner’ of a house, that was still costing me.
Keeping in mind, I thought the Pine Bush house would be sold soon, and that I’d have a decent amount to put down.

I got the mortgage, didn’t understand any of it, just sat there in a room full of bankers and lawyers (mine and theirs) and rejoiced in telling myself, I deserved this after all I went through (With my ex, with life, who knows). So, October 2006, I moved into a condo in one of the cheaper condo estates in Middletown NY. The inspection proved ok, if not pristine.

My second big mistake. I didn’t realize that I didn’t really wasn’t making enough for the mortgage, the ‘common’ costs (maintenance, upkeep, etc.) , and the ‘problems’ with the Pine Bush house, that still wasn’t sold, that were costing thousands of dollars I kept finding that more and more I couldn’t afford the Common costs and the mortgage on just what I was making. Meanwhile, the Pine Bush home was costing more and more for repairs, busted water pipes, the new boiler and more. Money I had to put out, taking loans for some of it, and trying to keep the condo going as well.

While I became extremely depressed, the work situation was getting worse and obviously my work was suffering. At the same time, I was beginning to have symptoms of what would eventually be diagnosed as ‘Meniere’s Disease’.
While I became extremely depressed, the work situation was getting worse and obviously my work was suffering.
I was trying to reduce my mortgage costs, I tried through Chase (who eventually ‘owned’ my mortgage) to reduce or ‘refinance’ my mortgage. Finally, after Chase Mortgage said that a ‘workout’ was not possible due to my Medical leave at work, I gave up on trying to keep the property.
This all led up to me leaving the condo in December of 2009, which was the date of the Foreclosure, as far as I could determine. That is how I lost the only property I owned totally by myself.

I recently signed papers in a Class lawsuit in NY State against Predator mortgage agencies and banks. We’ll see what happens. just this week while talking to a friend, it occurred to me, that I was victim to a ‘Perfect Storm’ of sorts.
Now I am working with MoveOn Sullivan, other progressive groups, and Occupy Hudson Valley groups to help others who are in Foreclosure to keep their homes.

The Occupy Movement: At Least One Founding Father Would Support Protests

Protest, Protest Protest!! Micheal Steele, (on MSNBC.. are they paying this guy?)….doesn’t like the Protesters,, e.g. Occupy Wall street. We should be down on our knees thanking OWS for being there. We would still be stuck in a useless discussion of the ‘debt’ rather than real issues that involve the people, the ‘real’ people on Main st. (not the imaginary extreme Right, ‘tea party’, ‘you are with us or you are NOT an American BS), One Founding father (not too well known), ROBERT YATES, NY state, founder, “….Yates also predicted that a distant and powerful federal government would soon be overrun by the wealthiest individuals. Brutus did not despise the rich, he merely thought they would have more resources to organize and to get themselves elected. This would be a bad result, he believed, because once so many rich people are in power, they will start to work for their own interests and not for the public good.”… he would have been with OWS today.

A reply to a ‘letter to the editor’ in the Times Herald Record, Monday, Feb. 13, 2012

I was quite perturbed and upset by a ‘letter to the editor’ in the Record yesterday, titled, ‘Obama’s maniacal minions’. In it, besides, mistakenly calling the ‘Occupy Wall Street ‘ movement a ‘super super pac’ under the ‘guise’ of a separate entity, for Obama, and claiming that they (OWS) has not ‘called out’ Obama on his hypocrisy regarding his earlier condemnation of SUPERpacs and I assume, his earlier disdain for such. Mr Clum of Walden, later claims that Occupy does not ‘protest’ against Obama donors such as GE (blatantly false, see “”), and calls OWS ‘disillusioned anarchists’ (among other epithets as ‘maladjusted’ , ‘proclaimed radicals’), ‘well financed’, again false. George Soros is on record having given a one- time donation to their cause, but having been down to Zuccotti park in NYC, before and after, they were evicted, I would never refer to these determined people of all stripes as ‘well financed’… I have been to several recent rallies and marches in support of OWS, (since October of 2011) along with Unions, old , young, leftists, anarchists, Republicans (Ron Paul supporters), Democrats, grandchildren, families, and grandmothers & other supporters. OWS has from the beginning, stated its Purpose, if not its ‘demands’ (it’s not a political party, as the Alternative ‘Tea’ party claims to be). I ask, has the gentleman ever looked at their website, which has continually stated (on its Right sidebar), “Occupy Wall Street is leaderless resistance movement with people of many colors, genders and political persuasions. The one thing we all have in common is that We Are The 99% that will no longer tolerate the greed and corruption of the 1%.”
OWS may or may not have begun the use of the terms ’99 %’ or ‘1 %’… I believe they borrowed them. I was at the showing of the documentary “Inside Job” ** this past Sunday, wherein, the analysis between the 1 % ,and the 99% percent, as terms were used. OWS, also further states that they use ‘ the Arab Spring tactic to … encourage the use of nonviolence to maximize the safety of all participants.’
You may disagree with their tactics, as I do with ‘some’ of the Tea parties’ also, but both of these groups have drastically changed our conversation in this nation, and I believe, if we can still talk, there is hope.
Personally, I supported Obama in ’08, but, as with so many Progressives these days, am almost just as disillusioned with him, as some Republicans. Mr Clum has every right to state his opinion as does the paper to print it, but instead of grandstanding with claims and terms as ‘maniacal minions’, and false claims, please try to educate yourself a little on the topic, before speaking. The rhetoric in this Election year is going to get to the point, where it’s just shouting and nothing more. I am a retired librarian, and, not perfect, in any sense. I am thankful that people ‘call’ me on some of my current and past views, but, it’s my nature to seek information and hopefully, truth. The Red/Blue state divide is false. I believe we need to change ‘radically’ (meaning at the ‘root’) our election process, stop calling each other ‘elitist’, ‘ignorant’, ‘Nazi’ this, ‘Fascist’ that, if we are going to be able to come together and solve some problems. It’s going to get deafening out there soon, and I hope we can all come to the table of humanity with a little respect, informed views, and try to work together. I am turning 60 next month, and protested the War in the 60’s and other things since, but cannot remember the country being as purposely divided, hopeless, and in such extremes of inequity. I don’t claim to know what the Founding Fathers meant (there are plenty of documents out there for us to see for ourselves), but, let’s turn off the TV and cable news at least one evening a week, search out the truth, or what we can find of it, and at least try to put ourselves, if not our country back on the road to communication.
